141 event that Licensor is a member of a performance
142 rights society (e.g. ASCAP, BMI, SESAC), via that
143 society, royalties for the public performance or
144 public digital performance (e.g. webcast) of the
147 <li><strong>Mechanical Rights and Statutory
148 Royalties</strong>. Licensor waives the exclusive
149 right to collect, whether individually or via a music
150 rights agency or designated agent (e.g. Harry Fox
151 Agency), royalties for any phonorecord You create
152 from the Work ("cover version") and distribute,
153 subject to the compulsory license created by 17 USC
154 Section 115 of the US Copyright Act (or the
155 equivalent in other jurisdictions).</li>
159 <li><strong>Webcasting Rights and Statutory
160 Royalties</strong>. For the avoidance of doubt, where the
161 Work is a sound recording, Licensor waives the exclusive
162 right to collect, whether individually or via a
163 performance-rights society (e.g. SoundExchange),
164 royalties for the public digital performance (e.g.
165 webcast) of the Work, subject to the compulsory license
166 created by 17 USC Section 114 of the US Copyright Act (or
167 the equivalent in other jurisdictions).</li>
170 <p>The above rights may be exercised in all media and
171 formats whether now known or hereafter devised. The above
172 rights include the right to make such modifications as are
173 technically necessary to exercise the rights in other media
174 and formats. All rights not expressly granted by Licensor
175 are hereby reserved.</p>
177 <p><strong>4. Restrictions.</strong> The license granted in
178 Section 3 above is expressly made subject to and limited by
179 the following restrictions:</p>
